This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of the domain name https://app.futurepathcounselling.in (“Website”), including the related mobile site and mobile application (hereinafter referred to as “Platform”).

The Platform is owned and operated by SHRAWAN KUMAR UPADHYAY HUF, with its registered office at D-618, Sai Chitra, Charkop, Sector 8, Kandivali West, Mumbai (hereinafter referred to as “Platform Owner,” “we,” “us,” or “our”).

Your use of the Platform and services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Platform, including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies applicable for such transaction. By mere use of the Platform, You shall be contracting with the Platform Owner and these Terms of Use including the policies constitute Your binding obligations with the Platform Owner.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE. PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

1. About the Platform

Future Path Intelligence Platform is a career guidance and psychometric assessment platform for students (Class 8 onwards) and working professionals in India. It administers a multi-section assessment covering personality, aptitude, emotional intelligence, learning style, values, motivation, and work style — and uses AI-assisted analysis to generate a personalised Human Development Blueprint™ report.

The Platform is an educational tool. It is not a clinical, diagnostic, psychological, or professional counselling service.

2. Terms of Use

The use of the Platform and/or availing of our Services is subject to the following:

1. To access and use the Services, you agree to provide true, accurate, and complete information to us during and after registration, and you shall be responsible for all acts done through the use of your registered account on the Platform.
2. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials offered on this Platform or through the Services for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
3. Your use of our Services and the Platform is solely and entirely at your own risk and discretion, for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the Services meet your requirements.
4. The contents of the Platform and the Services are proprietary to us and are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. The contents include and are not limited to the design, layout, look, graphics, assessment framework, question bank, scoring methodology, and the Human Development Blueprint™ format.
5. You acknowledge that unauthorised use of the Platform and/or the Services may lead to action against you as per these Terms of Use and/or applicable laws.
6. You agree to pay us the charges associated with availing the Services. Current pricing is published on our Pricing page. All fees are in Indian Rupees (INR) inclusive of applicable taxes.
7. You agree not to use the Platform and/or Services for any purpose that is unlawful, illegal, or forbidden by these Terms, or Indian or local laws that might apply to you.
8. You agree and acknowledge that the Platform may contain links to other third-party websites. On accessing these links, you will be governed by the terms of use and privacy policies of such third-party websites. These links are provided for your convenience only.
9. You understand that upon initiating a transaction for availing the Services, you are entering into a legally binding and enforceable contract with the Platform Owner for the Services.

3. Eligibility

• You must be at least 13 years of age to use the Platform independently.
• Users below 18 years of age must have the explicit consent of a parent or legal guardian before registering or completing an assessment.
• By using the Platform, you confirm that you meet the above requirements, or that a parent or guardian has consented on your behalf.
• The Platform is intended for users in India. Use from outside India is permitted but Indian law governs these Terms.

4. Assessment & Report

4.1 Honest Participation

The accuracy of your report depends entirely on the honesty and independence of your responses. You must answer all questions truthfully based on how you actually feel, think, and behave — not based on how you wish to appear. Complete the assessment independently, without influence from others, in a single focused sitting of approximately 35–50 minutes.

We accept no liability for reports that are inaccurate due to dishonest, rushed, or externally influenced responses. Such reports are not eligible for refunds.

4.2 Report Generation

• Your Human Development Blueprint™ is generated using AI-assisted analysis of your assessment data and is typically available within 2–15 minutes of completing the assessment.
• Each purchase entitles you to one report generation. A new assessment and report require a new purchase.
• Reports reflect your responses at the time of assessment. Interests and circumstances change — we encourage periodic reassessment.

4.3 Limitations You Accept

• Snapshot in time: The report reflects your self-perception on the date of assessment. It is not a permanent characterisation of who you are.
• Self-report basis: Psychometric assessments are based on self-reported responses. The report reflects how you see yourself, which may differ from objective measurement.
• Not a clinical diagnosis: Scores are developmental indicators, not clinical labels. They should not be used to limit or define yourself or others.
• AI-generated content: Report text is generated by artificial intelligence. While we apply careful prompting and review, AI may occasionally produce imprecise language.
• No guaranteed outcomes: The report does not guarantee employment, admission, salary, or any life outcome.

4.4 What We Will Never Do

• Recommend or discourage a career based on your gender, religion, caste, language, region, or family income.
• Tell you what career you “must” or “should” pursue.
• Guarantee employment, admission, salary, or any career outcome.
• Make any statement about your fundamental worth, intelligence, or value as a person.

5. Counselling Services

The Platform offers optional one-on-one counselling sessions with trained career guidance professionals. These sessions are intended to help you interpret your report and explore career directions in depth.

• Counselling sessions address career exploration, study planning, and goal-setting. They do not constitute psychological therapy, mental health treatment, or clinical counselling.
• If you are experiencing mental health concerns, we strongly encourage you to seek support from a qualified mental health professional.
• Counselling fees, booking, and cancellation are governed by our Refund & Cancellation Policy.

6. Payments

• Access to your full assessment report and counselling services requires payment. Prices are listed on our Pricing page.
• All payments are processed through a secure, RBI-authorised third-party payment gateway. We do not store card numbers, UPI credentials, or banking details on our servers.
• Payment confirmation will be sent to your registered email address.
• Refunds are governed by our Refund & Cancellation Policy.

7. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful, illegal, or forbidden purpose under Indian or applicable local laws.
• Submit false, misleading, or fabricated assessment responses or registration information.
• Create multiple accounts to circumvent assessment or payment limits.
• Share your account credentials with others or allow others to complete an assessment on your behalf.
• Attempt to reverse-engineer, decompile, or extract the Platform's source code, AI models, or assessment question bank.
• Use automated bots, scrapers, or crawlers to access or extract Platform data.
• Upload or transmit viruses, malware, or code designed to disrupt the Platform.
• Interfere with or disrupt the Platform's servers or infrastructure.
• Resell, sublicense, or commercially exploit access to assessment reports, counselling sessions, or any Platform content without written authorisation.
• Impersonate another person, organisation, or our staff.

8. Intellectual Property

All content on the Platform — including software, design, assessment framework, question bank, scoring methodology, Human Development Blueprint™ format, report templates, graphics, and logos — is the proprietary intellectual property of Shrawan Kumar Upadhyay HUF, licensed under applicable Indian and international intellectual property laws.

You may download, print, and share your own personal report for personal and educational purposes. You may not copy, reproduce, distribute, publish, or commercialise any other Platform content without prior written permission.

9. Disclaimer of Warranties

The Platform and all content are provided “as is” and “as available” without any warranty of any kind, express or implied. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials offered on this Platform for any specific purpose. You acknowledge that such information may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies to the fullest extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Shrawan Kumar Upadhyay HUF, its members, officers, employees, counsellors, and service providers shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of or reliance on the Platform or your report.
• Career decisions, academic choices, or life decisions made based on your report.
• Psychological distress, anxiety, or disappointment arising from receiving or reading your report.
• Inaccuracies in report content arising from incomplete, rushed, or dishonest assessment responses.
• Service interruptions, data loss, or technical failures beyond our reasonable control.

Our total cumulative liability for any claim arising from these Terms shall not exceed the amount you actually paid us for the specific service giving rise to the claim.

11. Indemnification

You shall indemnify and hold harmless the Platform Owner, its affiliates, group companies (as applicable) and their respective officers, directors, agents, and employees from any claim or demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of your breach of these Terms of Use, Privacy Policy and other policies, or your violation of any law, rules or regulations, or the rights (including infringement of intellectual property rights) of a third party.

12. Force Majeure

Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event, including but not limited to acts of God, natural disasters, war, civil unrest, government orders, internet or infrastructure outages, or any other event beyond the reasonable control of either party.

13. Privacy

Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described therein.

14. Governing Law & Jurisdiction

These Terms and any dispute or claim relating to them, or their enforceability, shall be governed by and construed in accordance with the laws of India.

All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

15. Changes to Terms

These Terms of Use can be modified at any time. It is your responsibility to periodically review these Terms to stay informed of updates. Continued use of the Platform after modifications constitutes your acceptance of the revised Terms.
