These Terms and Conditions (“Terms”) govern your use of the Future Path Intelligence Platform (“Platform” or “FPIP”) operated by Shrawan Kumar Upadhyay HUF (“we,” “our,” or “us”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Platform

Future Path Intelligence Platform is a career guidance and human development assessment platform. It uses AI-assisted psychometric analysis to generate a personalised Human Development Blueprint™ — a structured report designed to help students and young professionals understand their strengths, learning style, aptitudes, values, and compatible career ecosystems.

Important Disclaimer:

The Platform provides educational and career guidance information only. It is NOT a substitute for professional psychological counselling, academic advising, or career consulting from a licensed professional. Reports are generated using AI-assisted analysis and should be treated as one input in your decision-making process — not as a definitive prediction of your future or guaranteed career outcomes.

2. Eligibility

  • You must be at least 8 years of age to use the Platform.
  • Users below 18 years of age must have the consent of a parent or legal guardian.
  • By using the Platform, you represent that either you are above 18 or you have parental/guardian consent.
  • The Platform is intended for users in India. Use from outside India is permitted but Indian law governs these Terms.

3. Account Registration

  • You must create an account to access the assessment and reports.
  • You agree to provide accurate, complete, and current information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately of any unauthorised use of your account at info@futurepathcounselling.in.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Assessment and Reports

4.1 Assessment Conduct

  • You must answer all assessment questions honestly and independently. Responses influenced by others will reduce the accuracy of your report.
  • Each user is entitled to one assessment per account per purchase cycle.
  • Assessments once started cannot be reset or re-taken unless a new assessment is purchased.

4.2 Report Generation

  • Your Human Development Blueprint™ is generated by AI (Claude by Anthropic) using your assessment data.
  • Reports are generated within 2–24 hours of assessment completion.
  • We do not guarantee specific career outcomes, salary levels, or admission to educational institutions.
  • Reports reflect the state of your responses at the time of assessment. Life circumstances and interests change — we encourage periodic reassessment.

4.3 What We Will Never Do

  • Recommend or discourage a career based on your gender, religion, caste, region, or family income.
  • Guarantee employment, admission, or financial outcomes.
  • Tell you definitively what career you “should” pursue — we illuminate compatible directions.

5. Payments

  • Certain features of the Platform (report unlocking, counselling sessions) require payment.
  • All payments are processed through Cashfree Payments India Pvt. Ltd. (a RBI-authorised payment aggregator).
  • Prices are listed in Indian Rupees (INR) inclusive of applicable GST.
  • Payment confirmation is sent to your registered email address.
  • Please refer to our Refund Policy for cancellation and refund terms.

6. Intellectual Property

All content on the Platform — including software, design, text, graphics, logos, the assessment framework, the Human Development Blueprint™ format, and report templates — is the intellectual property of Shrawan Kumar Upadhyay HUF and is protected under applicable Indian and international copyright and trademark laws.

Your personal report is generated for your private use only. You may download and share your own report. You may not copy, reproduce, distribute, or commercialise any other content from the Platform without prior written permission.

7. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of these Terms.
  • Submit false information or impersonate another person.
  • Attempt to reverse-engineer, decompile, or extract the Platform's source code or AI models.
  • Use automated bots, scrapers, or crawlers to access the Platform.
  • Interfere with or disrupt the Platform's infrastructure.
  • Resell access to assessment reports or counselling sessions without authorisation.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Shrawan Kumar Upadhyay HUF shall not be liable for:

  • Any indirect, incidental, consequential, or punitive damages arising from your use of the Platform.
  • Career outcomes or decisions made based on your report.
  • Inaccuracies in AI-generated report content due to incomplete or dishonest assessment responses.
  • Service interruptions or data loss due to technical failures beyond our reasonable control.

Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation.

If negotiation fails, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended), with the seat of arbitration in India. The arbitration shall be conducted in English. The courts of India shall have jurisdiction for enforcement of arbitral awards.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by email or prominent notice on the Platform. Continued use after notice of changes constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue use of the Platform.
